Terms and Conditions

The General Terms and Conditions of Resort Finest B.V. apply to all agreements between the Customer and Resort Finest B.V. and its implementation via the website of Resort Finest B.V.

The General Terms and Conditions are understood to mean:

2. Customer: the natural person who, not acting in the exercise of a profession or business, as a customer purchases or repairs products and / or services at Resort Finest.
3. Cardholder: the natural person who, not acting in the exercise of a profession or business, purchases or repairs products and / or services as a cardholder at Resort Finest.
4. Products and / or services: products and / or services in the field of (ladies) fashion and lifestyle and other (related) articles insofar as they are sold by Resort Finest.
5. Agreement: the purchase with regard to products and / or services of Resort Finest that is concluded at the time of acceptance by the Customer of the offer and compliance with the associated conditions.

1. Resort Finest guarantees that the products and / or services comply with the agreement, the specifications stated in the offer and that they furthermore have the properties that are necessary for normal use, also for special use insofar as agreed.
2. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
3. Every offer is subject to obvious printing, typesetting or programming errors and available stock. The customer has the obligation to report inaccuracies in data provided or stated to Resort Finest without delay.

4. When advance payment has been agreed, up to a maximum of 50% of the purchase amount, the customer cannot derive any right from the execution of the relevant agreement or the relevant request for the provision of service (s) before the stipulated advance payment has been made.
5. In the event of late payment by the customer, Resort Finest is authorized to charge statutory interest, counting from the day the default commences, after written notice of default, until the day of payment. Any extrajudicial collection costs incurred by Resort Finest will be charged to the customer.
6. Resort Finest can - within legal frameworks - inform itself whether the customer can meet its payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the agreement. If Resort Finest is good on the basis of this investigation
has grounds for not entering into the agreement, Resort Finest is entitled to refuse an order or request, stating reasons, or to attach special conditions to the execution.

7. The prices stated in the offer of products and / or services are in Euros (€), including VAT, excluding delivery costs.

9. Delivery is deemed to have been made when Resort Finest places the customer in possession of the purchased product.

12. If the Agreement is concluded on the website of Resort Finest, the General Terms and Conditions are available for inspection on the relevant website.

Method of payment
13. The amount due to Resort Finest must be paid immediately upon placing the order, unless agreed otherwise.
14. If the agreement is concluded electronically, the text of these General Terms and Conditions will be made available to the customer electronically in such a way that it can be easily stored by the customer in a durable manner.

15. The agreement is concluded when Resort Finest confirms the customer's order by e-mail.
16. In the order of receipt, orders accepted by Resort Finest will be sent to the customer and will be executed within 30 (thirty) days if no longer delivery period has been agreed. If delivery is delayed, or if an order cannot or only partially be executed, the customer will be notified of this no later than one month after placing the order. Resort Finest has in that case the right to cancel the order without costs and refund any prepaid amount.

Review period
17. When purchasing products, the customer has the option to terminate the agreement without giving reasons or to exchange the purchased products during 30 (thirty) days, starting on the day after receipt of the product by or on behalf of the customer.
18. During this period, the customer will handle the product and packaging with care. The customer will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he makes use of his right of withdrawal, he will return the product with all accessories supplied and, if reasonably possible, in the original condition and packaging to Resort Finest, in accordance with the reasonable and clear instructions provided by Resort Finest.
19. If the customer exercises his right of withdrawal and returns the products to Resort Finest, shipping costs (if any) will be refunded (this concerns the costs from the warehouse / warehouse to the customer). The costs for returning are at your own expense.

21. Unless otherwise agreed, the customer has the right to return the purchased product within 30 days from the date of delivery of the purchased product upon presentation of the original purchase receipt.
22. The right to exchange occurs in accordance with the conditions in Article "Viewing period" of the General Terms and Conditions.
23. If the customer has paid an amount, Resort Finest will refund this amount as soon as possible, but no later than 14 (fourteen) days after receipt of the return or cancellation.
24. In any case, the right of withdrawal does not apply to the sale or purchase of goods that have been realized in accordance with the customer's specifications, that is to say, specially tailored, or where it is expressly stated that they cannot be exchanged.

Delivery address, delivery times and change of address
25. The address of delivery is the address that the customer has communicated to Resort Finest.
26. Orders placed on the above website, placed on working days before 1:00 pm, will be shipped the same day by Resort Finest. (During a busy period it may happen that a package is sent later, this is unfortunately force majeure.) The customer must pay for the order in advance (iDeal or credit card) and provide a home address as delivery address in one of the following countries: Netherlands , Belgium, Germany, UK, France, Austria, Italy and Spain. Other countries are available on request. Under certain circumstances, the delivery time can take up to 30 (thirty) days. The customer is made aware of this in advance.
27. If an order placed on the above website is paid per transfer, the delivery time is a maximum of 30 (thirty) days from the time of payment.
28. The customer is obliged to inform Resort Finest of any change of address. As long as Resort Finest has not received a move, the customer is deemed to be resident at the last address known to Resort Finest.

Method of payment
29. Resort Finest offers the possibility to pay via internet. During the ordering process, the customer can authorize the method of payment via the internet.
30. Resort Finest takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a safe web environment.

Contribution to delivery costs
31. The customer pays no contribution to the delivery costs per order.
32. When returning, € 5.95 delivery costs will be charged in the Netherlands. This amount can vary per country. Resort Finest uses the delivery costs of that country, which are indicated by delivery service DHL.
33. Complaints about the performance of the agreement must be submitted to Resort Finest in a timely, complete and clearly defined manner, after the customer has discovered the defects.
34. Complaints submitted to Resort Finest will be answered within a period of 14 (fourteen) days from the date of receipt. If a complaint requires a foreseeable longer processing time, Resort Finest replies within the period of 14 (fourteen) days with a message of receipt and an indication when the customer can expect a more detailed answer.
35. Before using the right of complaint, the customer must demonstrate at the request of Resort Finest that the agreement to which the complaint relates has been concluded with Resort Finest upon submission of the original proof of purchase or proof of collection for repair or keep the proof of order to (make) the purchased item and / or the items. 
36. If there is a discount / benefit within 24 hours of your online purchases. Please report to the relevant customer service in writing with your order number. At that time you are entitled to the discount / advantage offered.

Resort Finest takes into account the preferences of the customer. All agreements, to which these conditions have been declared applicable, are subject to Dutch law.

Changes in these General Terms and Conditions will only take effect after they have been published in an appropriate manner, it being understood that in the event of applicable changes during the term of an offer, the most favorable provision for the customer will prevail.
